General Terms and Conditions (GTC) for the Sale of Digital 3D Models and Custom Services
1. Scope
These General Terms and Conditions apply to all contracts between Manuela Ebel (hereinafter referred to as the "Provider") and her customers regarding the sale of digital 3D models as well as the provision of individual services (e.g., customization or re-texturing of models).
2. Contracting Parties
The contract is concluded between the customer and the provider. In the case of sales through third-party platforms, the terms and conditions of those platforms also apply.
3. Description of Services
- The provider sells digital 3D models in various formats through third-party platforms.
- Upon request, the provider offers individual customizations, re-texturing, or model variants. These services are provided exclusively by prior agreement and individual consultation.
4. Copyright and Usage Rights
- All digital content is protected by copyright.
- Upon purchase, the customer receives a simple, non-exclusive right of use in accordance with the license terms of the respective platform or a separate agreement.
- Redistribution or resale of the content is only permitted if expressly authorized.
5. Prices and Payment
- The prices stated on the respective platform or in the individual offer shall apply.
- Payment is made using the payment methods provided by the provider or the third-party platform.
6. Delivery / Download
- Digital products are made available to the customer for download immediately after purchase via the respective platform.
- Individual services are provided by arrangement and, if applicable, made available via email or download link.
7. No right of withdrawal for digital content
When purchasing digital content, the statutory right of withdrawal expires as soon as the download has started, provided the customer has explicitly agreed to this (§ 356 para. 5 BGB).
8. Liability
- The provider is only liable for intent and gross negligence.
- No liability for compatibility issues with the customer's software or hardware.
9. Final provisions
- The law of the Federal Republic of Germany applies.
- If individual provisions of these terms and conditions are invalid, the validity of the remaining provisions shall remain unaffected.
