General Terms and Conditions (GTC)

for the sale of digital 3D models and custom services

1. Scope

These General Terms and Conditions apply to all contracts between

Manuela Ebel – EbelMesh 3D Studio (hereinafter referred to as the “Provider”)

and their customers regarding the sale of digital 3D models, textures, as well as the provision of custom services (e.g., customization, re-texturing, or bespoke creations).

When purchasing through third-party platforms (e.g., TurboSquid, CGTrader, Unity Asset Store), their respective terms of use and business conditions also apply.

2. Contracting Parties

The contract is concluded between the customer and the provider.

3. Description of Services

The provider creates and sells digital 3D models, PBR textures, and similar digital content in various formats.

Additionally, the provider offers custom services, such as

  • modifications of existing models,
  • re-texturing,
  • or the creation of new models according to the customer’s specifications.

These services are provided only after prior consultation and written confirmation.

4. Copyright and Usage Rights

All digital content is protected by copyright.

With the purchase, the customer receives a simple, non-transferable right of use in accordance with the license terms of the respective platform or a separate agreement.

An distribution, reproduction, publication, or resale of the content is not permitted, unless explicitly permitted in writing.

5. Prices and Payment

The prices specified on the platform or in the individual offer apply.

All prices are final prices (including any applicable taxes).

Payment is made via the payment methods offered on the respective platform.

6. Delivery / Download

Digital products are made available for download immediately via the respective platform after payment is completed Download provided.

Custom services are delivered via email or download link upon completion.

7. Right of Withdrawal for Digital Content

When purchasing digital content, the statutory right of withdrawal expires,

as soon as the download or the provision has begun and the customer has expressly agreed to it (Section 356(5) of the German Civil Code).

8. Liability

The provider is liable only in cases of intent or gross negligence.

No liability is assumed for:

  • Compatibility issues with the customer’s software, hardware, or operating systems,
  • or damages resulting from improper use of the content.

9. Final Provisions

The law of Federal Republic of Germany.

If individual provisions of these GTC are invalid or incomplete,

the validity of the remaining provisions remains unaffected.
